So what's the verdict? Is gifting a basket of cheer to a community organization that will be offered ina chinese auction allowable by law? The person would be purchasing ticket, and placing said tickets in the basket they wish to win. They are not specifically purchasing the contents of said basket, only a chance to with said contents.

What do you say?
 
This has always been a gray area of the laws, which varies around the country. Check with your own local authorities- most of the time they won't even know.
 
A friend of mine got in trouble for just such an issue. It almost jeopardized his federal winery application as well. Granted, he was actually turned in by a not so nice individual. But it was deemed to be illegal. Remember, the home winemaking laws were designed for personal consumption. Giving away a bottle to a friend is one thing but providing wine for an organization to benefit from financially, even indirectly, is not the intention of the law. Better to err on the side of caution.
 
Thanks, I've read the many debates on the subject here and just wanted to clarify. We have an event this weekend, I'll hold off on donating this time around.
 
Chances are you would be OK but it could also blow up in your face if someone gets wind of anything improper and complains to the right authorities... :se
