In Virginia, wine tasting is not to be taken lightly. At each winery, you are greeted by the following sign........

it provides the entry point for a lawyer and agro tourist to possible fight back

B. Nothing in subsection A shall prevent or limit the liability of an agritourism professional if the
agritourism professional does any one or more of the following:
1. Commits an act or omission that constitutes negligence or willful or wanton disregard
for the safety of the participant, and that act or omission proximately causes injury,
damage, or death to the participant;
2. Has actual knowledge or reasonably should have known of a dangerous condition on
the land or in the facilities or equipment used in the activity, or the dangerous
propensity of a particular animal used in such activity and does not make the danger
known to the participant, and the danger proximately causes injury, damage, or death
to the participant; or
3. Intentionally injures the participant.
 
If you are enjoying your "agritourism" enough you won't be worried about the sign :p
 
That's why we should taste responsibly when enjoying agritourism. Some vinyards that we have been to will limit how much you try at one time. There is one solution though, you can get into one of those group tours were you do not have to do any driving. :d
 
I wonder how often that law is challenged or how often cases resulting from such actions go to a higher court.

Should my child be hurt in a crash resulting from someone being "over served" you can bet your sweet @$$ that heads would roll, law or not.
